  • Fully Managed Service: A comprehensive service that includes coordination, logistical support, and progress tracking throughout the client’s training.

  • Third-Party Providers: External organisations, including Flight Training Organisations (FTOs), engaged by the client for training services.

  • Client Needs: The requirements and preferences outlined by the client in writing, forming the basis of the services provided.

  • Advisory Services: Recommendations and guidance offered to clients without guarantees of specific outcomes.

 

3. Services

3.1 We offer the following services:

  • Customised Training Plans

  • Autopilot - Modular Managed Service

  • Fully Managed Service

3.2 Specific details of each service tier are outlined on our Website and in the individual service agreements.

3.3 Scope of Services:

  • Our services include advisory, planning, and management services. We provide guidance and recommendations but do not guarantee outcomes such as successful licensure, employment, or training completion.

  • Third-party services, including FTOs, are engaged at the client’s discretion. We are not liable for their performance, quality, or suitability.

 

4. User Accounts

4.1 Some areas of the Website require you to register a user account. You agree to be responsible for maintaining the confidentiality of your account and password.

4.2 You accept responsibility for all activities that occur under your account or password. We reserve the right to terminate accounts or refuse service if these terms are violated.

 

5. Intellectual Property

5.1 All content on this Website, including text, graphics, logos, images, and software, is the property of Mentored Modular Ltd and is protected by UK and international copyright laws.

5.2 Training plans and advisory materials remain the intellectual property of Mentored Modular Ltd and cannot be shared, sold, or reused without our explicit written consent.

5.3 You may view, download, and print pages from the Website for personal use, subject to the restrictions outlined in these terms.

 

6. Payment Terms

6.1 Fees for our services are outlined on our Website and in individual agreements.

6.2 All payments must be made in full before the delivery of services unless otherwise agreed in writing.

6.3 We reserve the right to change our fees at any time, but changes will not affect accepted orders.

6.4 For the Fully Managed Service, payments are due monthly via direct debit. Late payments may result in service suspension.

 

7. Cancellation and Refunds

7.1 Right to Cancel:

You may cancel your order within 14 days of purchase without providing a reason, in accordance with the Consumer Contracts Regulations 2013.

7.2 Pro-Rata Refunds:

If you request service commencement during the cancellation period, you must pay for services performed up to cancellation.

7.3 Specific Terms:

  • Service-specific cancellation terms are outlined in individual agreements.

  • For the Fully Managed Service, cancellations require a 30-day notice period.

 

8. Guarantee and Refund Policy

8.1 Guarantee Details:

We provide a 100% money-back guarantee if our training plans fail to meet the needs explicitly outlined by you in the training plan questionnaire and through subsequent discussions.

  • Aim to Meet Optimal Criteria: We will aim to identify and recommend the best, cheapest, and fastest training options available based on the information provided. However, these aims do not form part of the guarantee.

  • Definition of Needs: Needs refer to the preferences and requirements you communicate to us in writing. The guarantee ensures alignment with these stated needs and does not imply the absolute cheapest, quickest, or best training options.

  • Eligibility for Refund: Refunds are only applicable if you demonstrate that the training plan does not meet the needs specified before its preparation.

8.2 Exclusions:

  • Refunds are not provided for changes in preferences after plan delivery.

  • Dissatisfaction not directly related to the communicated criteria will not qualify for refunds.

 

9. Client Responsibilities

9.1 Accurate Information:

You are responsible for providing accurate, complete, and timely information in your training plan questionnaire and other communications.

9.2 Adherence to Instructions:

Following our recommendations and timelines is essential for the success of the training plan. Non-compliance may affect results, for which we are not responsible.

9.3 Regulatory Compliance:

You must ensure compliance with all legal and regulatory requirements for pilot training and licensing, including medical examinations and background checks.

9.4 Engagement for Fully Managed Service:

Clients using the Fully Managed Service must actively participate in decision-making processes and provide prompt feedback to ensure smooth coordination.

 

10. Limitations of Liability

10.1 No Guarantees on Outcomes:

While we strive to provide the best possible advice, success in training, including passing exams and obtaining licensure, depends on your performance and the quality of third-party providers.

10.2 Third-Party Providers:

We are not responsible for issues arising from third-party services, including delays, substandard training, or failure to meet regulatory requirements.

10.3 Indirect Damages:

We are not liable for indirect, incidental, or consequential damages, including financial losses, arising from the use of our services.

10.4 Advisory Nature:

Our role is limited to providing advice and creating plans based on the information you provide. Implementation and success depend on third-party service providers and your actions.

10.5 Fully Managed Service:

We facilitate and manage various aspects of your training process but are not liable for outcomes resulting from decisions made by FTOs, instructors, or other third-party providers.

 

11. Feedback and Reviews

11.1 By using our services, you grant Mentored Modular Ltd permission to use anonymised feedback, reviews, or outcomes for marketing, improvement, or case studies.

 

12. Dispute Resolution

12.1 Complaints:

Complaints must be submitted in writing. We will acknowledge receipt within 14 business days and respond within 14 business days.

12.2 Escalation Process:

If unresolved, disputes may be referred to an internal review, followed by mediation through the Chartered Trading Standards Institute (CTSI).

 

13. Non-Compete and Non-Solicitation

13.1 Clients agree not to use our services to create competing businesses or solicit our employees or service providers for competing purposes for a period of two years after the end of the service agreement.

 

14. Force Majeure

Mentored Modular Ltd is not responsible for delays or failures caused by circumstances beyond our control, including natural disasters, government actions, or industry disruptions.

 

15. Governing Law and Jurisdiction

These terms and conditions are governed by the laws of England and Wales. Disputes will be resolved exclusively in the courts of England and Wales.

 

16. Changes to Terms and Conditions

We reserve the right to update these terms at any time. Continued use of the Website and services after changes indicates acceptance.
